Smithville Communications and/or Smithville Telecom (dba Smithville Fiber and henceforth referred to as “Smithville Fiber” or “We”) respect your privacy and are committed to protecting it through our compliance with this policy.

This privacy notice describes the types of information we may collect from you or that you may provide through your use of Smithville Fiber’s cable video, high-speed internet, phone service and communications, and home security services or when you visit the website, www.smithville.com (our “Website”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our services or Website. By accessing or using this Website, you agree to this privacy policy. Information We Collect and How We Collect It

In order for Smithville Fiber to provide exceptional telecommunication service(s) to you, we keep pertinent business records containing information about you, including information by which   you may be personally identified (“personal information”).  These account records may include, but is not limited to, the following information:

  • service address and/or location;
  • billing address;
  • driver’s license number;
  • social security number;
  • telephone number;
  • e-mail address;
  • billing and payment history;
  • bank account number;
  • credit card number
  • communications records;
  • maintenance information;
  • the device identifiers and/or network addresses for equipment in use; and
  • service contracts.

We also collect several types of information from and about users of our Website.  Information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website. We may also ask you for information when you report a problem with our Website or regarding our services.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Smithville Fiber’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Smithville Fiber about our customers and Website users is among the assets transferred;

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We do not sell personal information of our customer or our Website users to any third party for the purpose of marketing their products.

Data Security

We have implemented industry-standard practices to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. However, we cannot guarantee these practices will prevent every unauthorized attempt to access, or disclose personal information.  Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained in our systems or on the Website.  The safety and security of your information also depends on you. Cable Communications Policy Act of 1984

According to section 631 of the federal Cable Communications Policy Act of 1984, (the “Cable Act”), Smithville Fiber is bound by the Cable Act concerning the collection and dissemination of certain information collected regarding each customer.  This includes:

  • the limitations upon cable operators concerning the assembly and use of subscriber’s personal information;
  • the personal information we collect and use;
  • to whom and why we might disclose personal information;
  • the length of time we hold personal information; and
  • how customers might access this information.

Customer Proprietary Network Information (CPNI) Policy

In addition, Section 222 of the Cable Act provides additional privacy protections for certain information related to our phone and internet services:

  • Information which relates to the quantity, technical configuration, type, destination, and amount of use of a telecommunications service subscribed to by any customer,
  • Information contained in the bills pertaining to telephone exchange service or telephone toll service received by a customer of a carrier.

That information is known as customer proprietary network information or “CPNI.”

If you are a customer of our phone and internet services, you have the right, and Smithville Fiber has a duty, under the Cable Act and applicable state law, to protect the confidentiality of CPNI. In addition, the FCC’s rules provide additional privacy protections specific to our phone services.

The Cable Act prohibits us from using the cable system to collect personal information concerning any customer for any purposes other than as set forth herein, as permitted or required by law, or with your approval without the customer’s prior written or electronic consent.   More detailed information is available at www.fcc.gov.

Smithville Fiber utilizes email as an effective way to communicate with our customers and Website users. We may send welcome messages as well as service-related messages, including price changes, service appointments, product updates, and/or change in features. These message are important for continued service so you may not opt-out of these service-related emails.

We reserve the right to send you promotional e-mails about our services as permitted by applicable law.  To opt-out of receiving promotional or marketing e-mails from Smithville Fiber, you may:

  • Easily use the unsubscribe link in the footer of any e-mail sent by Smithville Fiber.
  • Unsubscribe by signing into your account on our Website and indicating your opt-out preference within your account preferences.

 Privacy Policy for Children Under 13

Our Website is not intended for children under 13 years of age. We do not knowingly collect personally identifying information from anyone under the age of 13 .  If you are under 13, do not use or provide any information on our Website. Any online contests, sweepstakes, or mobile access is therefore restricted to entrants who are 13 years or older.  If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.  If you believe we might have any information from or about a child under 13, please contact us as set forth below.
